Man Defies Social Security, Secures Retirement at 58 with €2,250 Monthly Pension Despite Initial Rejection

In recent months, unusual cases have emerged where Social Security users manage to retire despite allegedly failing to meet one of the agency’s minimum requirements. One such case involves a man who successfully retired at age 58 after the National Social Security Institute (INSS) rejected his initial application, prompting the Superior Court of Justice of Cantabria to intervene and force a reversal of the decision.

This was not a typical case. The man worked in the metallurgy sector until 2024, when he applied for permanent disability due to physical problems stemming from his back. Medical reports indicated he suffered from severe lower back pain, which significantly hindered his ability to perform his job efficiently. Nevertheless, Social Security denied his first request, despite the medical records also showing that he had a serious psychiatric condition linked to obsessive-compulsive disorder and a prolonged grief situation that exacerbated his psychological symptoms.

Given his age of 58 and his inability to work, it was unlikely that he could continue contributing to the social security system until reaching the minimum retirement age in Spain. The man appealed the decision, and the court ultimately ruled in his favor, ordering Social Security to grant him a lifetime pension of 55% of his regulatory base (with a 20% increase), based on a regulatory base of €3,003.34. This translates to a monthly payment of €2,252.50 starting at age 58.

Critically, the Superior Court of Justice of Cantabria did not grant a total permanent disability pension. According to the ruling, the man could have worked in other environments that do not require significant physical effort. This decision highlights the balance between acknowledging severe health issues and recognizing residual capacity for alternative employment.
